בחברה בה נראה, לפעמים, כאילו מוצע לנו חופש אין-סופי כמעט, אנשים מבולבלים לעתים קרובות כאשר הם מגלים שהחופש שלהם הוגבל לפתע, בדרכים לא הגיוניות ודורסניות.

האנשים שהעולם בבעלותם היום נחושים לוודא שחרא מהסוג הזה לא יקרה להם. תהיה לכם טונה של חופש. תכתבו איזו שירה מפגרת וארורה שתרצו, ואיש לא יקשיב. אתם יכולים להיות בטוחים כמה שאתם רוצים שהחופש החוקי שלכם מוגן על ידי החוק. אתם גם יכולים להפר חוקים מסוימים עם פטירה כמעט מיידית מעונש ולשכנע את עצמכם שאתם מורדים. והכי חשוב, אפשר לזיין מי ומה שרוצים בכל דרך מזוינת שתרצו. אנשים ממש מתלהבים מהקטע האחרון.

יש לכם גם חירות שנעשתה חובה חברתית. היא לקנות כמה שיותר דברים שאתם יכולים להרשות לעצמכם. די לחסוך, ילדים, זה לטובת המדינה. תשיגו כרטיס אשראי וקנו לחג המולד! דילדואים אנאליים! נגני די וי די עם דיסק מקס הרדקור של מבחר זוויות מצלמה במתנה! מקטרות לקראק ובאנגים מזכוכית עבודת יד! אוסף עבודותיו של קארל מרקס וקרופוטקין! קנו מהפכה, קנו סקס, קנו סמים, אך אל תשכחו לקנות.

המציאות היא שחופש קיים רק עד השלב בו הוא משתיק אותך ומשכנע אותך לקנות דברים. הרגע בו הפעולות שלך מפליגות לשם, הוא הרגע בו אתה נכבה, חוקי באופן טכני או לא. אל תבזבז אנרגיה במחשבות על איך אמריקה היא מדינה חופשית או על כמה לא-חוקי ה(די אמ סי איי?) הוא או מה שלא יהיה. אם התשוקות שלך נופלות בתוך החומה הבלתי-נראית שהוקצתה לך, הן חיות ומתות מאושרות. אם לא, תפעל בשקט. אבל אל תצפה שזכיותיך ילקחו ברצינות בחברה בה אפשר לעשות כל מה שרוצים- כל עוד זה לא חשוב.

שלטים ללא שליטה.

ביום ראשון השבוע נפלטו ממכשיר הפקס במשרד מספר דפים מודפסים ובהם תגובת עיריית תל אביב לעתירה שהגשנו ביוני האחרון נגד מסכי הפרסום האלקטרוניים (את העתירה המלאה ניתן לקרוא בכתובת: http:\\www.greenaction.org.il/atira2.doc). תמצית תגובת העיריה מתבססת על חוק העזר העירוני לנושא שילוט מ-1992. לאחר שהיא מפרטת באריכות את הקריטריונים להצבת שלט פרסום אלקטורניים כותבת ב"כ של העירייה, עו"ד פלאית אורנשטיין, כי למרות שעל פי חוק "לא יותקן ולא יוצב שלט עסקי אם נתקיימו בו אחד מאלה: (1) השלט נושא אורות נעים או מהבהבים או נדלקים וכבים. (2) השלט מהווה סכנה או הפרעה לבטיחות המשתמשים בדרך", לועדה המקצועית המוסמכת לייעץ לראש העיר בנושא לא הוענקו בחוק העזר הסמכות והכלים הדרושים על מנת לבדוק באם בשלט יש משום סכנה בטיחותית לנוסעים בדרך. לכן למעשה ועדה זו אינה מומסכת לאסור את הצבתם.

העיריה נתלית בטענה שחוק הדרכים אוסר על הצבת שלטי פרסום בדרכים בין עירוניות בלבד, ואילו הטלויזיות מוצבות בדרכים עירוניות. אך גישה זו מחייבת להזכיר כי תכליתו של חוק הדרכים הינו להגן על בטיחותם של הנוסעים, ובהקשר זה קשה למצוא שוני מהותי בין לבלבל נהג שנוסע בדרך נמיר או נתיבי איילון, לבין הסטת תשומת ליבו בכל כביש בין עירוני אחר. מצער מאוד שעיריית תל אביב נתלית בענף דקיק כל כך על מנת להמשיך ולהרוויח מהעמלות הגבוהות שהיא גובה ממציבי השלטים, על חשבון בטיחות הנוסעים.

לבסוף, משנה העיריה כיוון -- אחרי שפירשה את חוק הדרכים בצורה צרה מאוד, היא נותנת פרשנות מעניינת לחוק העזר בנושא שילוט. לטענת העיריה, החוק משנת 1992, כבר אינו תואם את רוח הזמן. בשנת 1992, כותבת העירייה "הפרסום נעשה באמצעים טכנולוגיים השונים מהיום…(החוק) פורש בהתאמה להווה בו התפתחה טכנולוגית הפרסום שבאה לידי ביטוי בשילוט אלקטרוני על גבי מסכי טלויזיה. במציאת האיזון בין התפתחות מואצת זו של אמצעי הפרסום לבין שמירת איכות הסביבה, אשרה הועדה מטעמים מיוחדים הצבת 7 מסכים בצמתים בעיר". ולכן "על שופט לפרש את החוק וליתן לו משמעות כפי שנדרש בעת פירושו ולא ביום חקיקתו".

העיריה טוענת למעשה כי העובדה שהיא עוברת על החוק באופן בוטה פשוט "תואמת את רוח הזמן". ומה לעשות, אולי היא צודקת, כי רוח הזמן מעודדת מיקסום רווחים על חשבון טובת האזרח.

המועצה הישראלית לצרכנות הוקמה מכוח החלטת ממשלה בשנת 69', מאז לא עוגן מעמדה בחוק והיא נסמכת על שולחנו של משרד התמ"ס. לאחרונה קוצץ תקציבה, הלא גדול ממילא, בעוד 40%, ונעשו נסיונות רבים לשלב בדירקטוריון שלה מינויים אישיים של אולמרט וחבר מרעיו.

הכדור בידינו
כנס "הכדור בידינו" לחינוך סביבתי, בהפקת מרכז השל, יתקיים זו השנה השביעית ב-9.12.04 במדיטק חולון. השנה יתקיים הכנס בסימן "חינוך סביבתי והרשות המקומית".

Tomorrow (26/11) Buy Nothing Day Events Nationwide!

Tel-Aviv
starting on 11:00 an exhibition making celebration, costumes and supermarket carts decoration in Dizengoff square. With the decorated carts, we will go on a festive shopping cart (12:00). We will then adjurn in a heppening in the Maksim movie theater square (Ben Tzion Avenue and King George). On the square a Fair Trade tent will be raised, handing out exploitation free tea and coffee, and including discussions on consumerism, its consequences and sustainable alternatives to anyone interested!

We will hold a trading market (bring clothes, books and exchangable items). Starting on 13:00 we will commence a street party


And of course: exhibitions, galleries, street theater and more...

Kfar-Saba
today, Thursday, a youth activity against consumerism will take place. Information leaflets will be handed, DIY workshops hosted, and free fair trade tea and coffee will be offered. We will meet by the shopping mall in Vytzman street at 17:00.

Jerusalem
On Friday an informational activity in the Mashbir square, will take place between 11:00 and 15:00. At the same time, a trading market will be held in Sergei garden-Nature Protection Society in Jerusalem, Heleni Hamalka street 13 between 11:00 and 14:00. Haifa
A journey from mall to mall: on Friday at 11:00 afternoon, a colourful march and street theater will leave Horev Center towards The Grand Kenyon. Please bring musical instruments and costumes.
At night a protest activity against the consumerist night culture will take place in Merkaz Hacarmel-Haifas coffee shops and pubs area. We will give out free fair trade tea and coffee! Meet us at 21:00 by McDonalds in Merkaz Hacarmel.

You Can Do Anything You Want to, as Long as It's not Important

the mantra of modern power.

In a society where it sometimes seems that we are offered nearly unlimited freedom, it often puzzles people when they discover that their freedom has suddenly been restricted in illogical and brutal ways.

Thus, mild mannered folk singers discover that their excruciatingly boring songs have been banned, people who make cogent legal arguments about the manner in which a protester was arrested get a quick squirt of pepper spray in the eyes, and people are surprised to discover that despite laws to the contrary, nearly every phone call and e-mail they have ever made has been monitored by unaccountable secret agencies.

Invariably, there is a hue and cry about the injustice and unconstitutionality of this latest atrocity, and a demand that natural human rights be respected. And invariably, a big fat silent raspberry is blown in the demander's direction.

Meanwhile, every conveivable variety of disgusting porn is freely available online, including variations that involve children and animals. People chit-chat openly about smoking and growing marijuana (an ostensibly illegal act). Grey bearded professors discuss the relative merits of classical Marxism and Bakuninian anarchism as tactics of revolutionary struggle. Swingers clubs, cocaine dealers, sadomasochist dungeons, NAMBLA, communists and anarchists go about meeting and doing their business quite freely.

The truth is, the people who really run society would quite happily use the Constitution to light their cigar. They only care about two things: profits and enough stability to ensure more of the same. They saw the way places like Nazi Germany and the Soviet Union went. Total disrespect for authority. Armed guerillas. Rampant theft and corruption. Renegade poet dissident intellectuals. And eventually, total collapse of the system followed.

The people who own the world today are determined to see that this sort of shit doesn't happen to them. You will have lots of freedom. You will write whatever goddamn silly ass poetry you want to, and nobody will listen. You can assure yourself as much as you want to that your constitutional freedom is protected by law. You can also break certain laws with near impunity to convince yourself you're a rebel. And most importantly, you can fuck anyone and anything in any damn way that pleases you. People get real hung up on that one.

You also have a freedom that has become a social duty. It is to buy as much stuff as you can possibly afford. No hoarding now kids, this is for the good of your country. Get a credit card and buy for Christmas! Anal dildos! DVD players with a complimentary selection of multiple camera angle Max Hardcore discs! Crack pipes and handblown glass bongs! The collected works of Karl Marx and Kropotkin! Buy revolution, buy sex, buy drugs, but don't forget to buy.

The reality is, freedom exists only so far as it shuts you up and convinces you to buy things. The moment your actions go beyond that, you are shut down, technically legal or not. Don't waste your breath talking about how America is a free country or how unconstitutional the DMCA is or whatever. If your desires fall within the invisible wall allotted you, they live and die happy. If not, then act silently. But don't expect your whining to be taken seriously in a society where you can do anything you want, as long as it's not important.

Out of Control Billboards

On Sunday this week several printed papers were ejected from our fax machine, detailing the response of the Tel Aviv Municipality to the petition we filed on the past June against the electronic advertisement screens (the full petition can be read in Hebrew at this adress: http:\\www.greenaction.org.il/atira2.doc). At the essence of the municipalitys response is the bylaw regarding billboards from 1992. After having detailed, at length, the criteria for posing an electronic billboard ad, the municipalitys representator, Attorney Plait Orenshtein, writes that despite the law stating that "a corporate sign will not be installed or posted if it (1) includes moving or flashing lights (2) is regarded as dangerous or disturbing to the safety of the drivers". The proffessional committee authorised to advise the mayor on the subject was not given the authority or tools to check wether the signs pose a safety hazard to the travellers. So, in practice, this committee is not authorised to ban their installation.

The municipality is hanging by the claim that the roads bylaw forbids posing billboards in highways only, and the televisions are located by city roads. But it is necessary to awknowledge that this law's purpose is to guard the travelers safety, and in this context there is no fundamental difference between confusing a driver going through Namir Road or Ayalon Highway, and between capturing his attention on any other intercity road. It is very unfortunate that the Tel Aviv municipality is hanging by a branch so thin so as to continue and profit from the high comission it is payed by the television posers, on the expense of the drivers safety.

At last, the municipality changes lanes-after having interpreted the roads law very narrowly, it encloses an interesting interpretation of the bylaw regarding billboards. According to the municipality, the law from 1992 no longer holds with the spirit of the times. In 1992, the municipality writes "advertising was done in technological means different than todays.. (the law) was interpreted in accordance with the present in which the advertising technology has developed, such as in electronic advertising across television screens. In finding the balance between this accelerated development of advertising means and preserving the environment, the committee has confirmed the posing of 7 screens in city intersections, out of special considerations." And so "a judge must interpret the law and give it meaning as demanded when interpreted and not when legislated."

The city, in practice, claims that the fact it is blatantly breaking the law simply is "in accordance with the times" and what can we say? Perhaps its right, because the spirit of the times encourages maximum profits at the expense of the citizen.



And if that's not Enough...

Advertising chases us anywhere. We find them on the TV, in newspapers, on billboards, in parking lots, on public benches and sometimes also in public bathrooms. Soon, it seems, we will also find them in gas stations.



Junk Food Advertising Limitation in Britain

In the British Islands they got the message marketing directors have known for a long time-advertisements affect children, and as a result, the direct access corporate companies have on childrens minds have been limited slightly. As a first step the hours in which junk food can be advertised on the telly have been limited.

Talented designers are welcome to offer their help in the task of designing the fair trade coffee and olive oil packages that we will begin marketing soon. The job is voluntary, satisfaction guaranteed.



Mazal Celebrating a Birthday

Salon Mazal, an information center for social change is celebrating its third year. Maybe it seems it has always been here, and still, much work and resources are invested in the daily operation of a place catering to very broad audiences. To celebrate the occasion, a party will be thrown, with the profits dedicated to the Salons continued operation.

The party will be held on Saturday, 4/11/04 in Zamir cinema (Alenby 34), starting at 20:00. We will all be there, full of energy, straight from the Israeli Buisness Committee, to dance to the music of The Billuim, Yahali Sobol, Vaadat Kishut, DJ Eliot (Sharon Ben Azar), DJ Rob Random (London, Drum n' Bass).

The event will be hosted by Eran Shadar and the Mazal girl MOLMOL, stands will be posed, the welcome will be warm, and other surprises.

The Planet is Ours

The Planet is Ours Conference for Environmental Education, produced by the Heschel Center, will focus this year on environmental education and the local authority.
During the conference we will hold a workshop regarding consumerism, inspecting the cultural and social implications of the shopping malls phenomenon, slowly replacing the urban street. Who gets hurt in the process, and what does it have to do with democracy and education? (Hosted by Avi Levi and Eilat Maoz - Green Action, David Donitz - The Green Network.
